1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and FourTwo Enterprises LLC, operating under its own name and its studio divisions including 42DIGITAL ("Company", "we", "us", or "our").

By accessing, downloading, or using any of our applications, websites, or associated services (collectively, the "Services"), you acknowledge that you have read, understood, and agreed to be bound by all of these terms. If you do not agree with all of these terms, you are expressly prohibited from using the Services and must discontinue use immediately.

2. User Accounts

Where the Services require you to create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

3. Intellectual Property Rights

Unless otherwise indicated, the Services and their original content, features, functionality, and software code (including but not limited to the 42DIGITAL branding, audio, video, text, and graphics) are the exclusive property of FourTwo Enterprises LLC and are protected by international copyright, trademark, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Services strictly for your personal, non-commercial use.

4. Purchases and Subscriptions

Certain Services may offer in-app purchases or automatically renewing subscriptions. By initiating a purchase, you agree to the pricing and payment terms presented at the time of purchase. All billing and transaction processes are handled by the respective app store provider (e.g., Apple App Store, Google Play), and you are subject to their specific terms of service and refund policies.

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. FOURTWO ENTERPRISES LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOURTWO ENTERPRISES LLC AND ITS DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DATA LOSS, SYSTEM FAILURE, OR LOSS OF PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

In no event shall our total liability to you for all claims arising out of or relating to the use of the Services exceed the amount paid by you, if any, to us during the six (6) month period prior to the cause of action.

8. Platform Provider Rules

If you access the Services via Apple Inc. or Google LLC, these third-party platform providers are not parties to this agreement and are not responsible for the provision or support of the Services. Your use of the Services must also comply with the usage rules set forth in your respective platform provider’s terms of service.

9. Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles. You and FourTwo Enterprises LLC irrevocably consent to the exclusive jurisdiction of the state and federal courts located in New Mexico for the resolution of any disputes.

10. Modifications

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will alert you to any changes by updating the "Last Modified" date of this document. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
